Terms of service

1. Who we are
FirstTouch Sales is provided by Pretiosus, a sole proprietorship based in Kochi, India (“we”, “us”). Our address is 3rd Floor, JC Chambers, V970 (Bldg No. 60/44), Panampilly Nagar Avenue, Panampilly Nagar (Opp. Kairali Apartments), Kochi, Ernakulam, Kerala 682036, India.
These terms apply to your use of FirstTouch Sales (the “service”) by you and by the people in your workspace. If you use the service for an organisation, you confirm that you may accept these terms on its behalf.
2. The service
FirstTouch Sales helps sales teams keep track of companies, contacts, enquiries, deals and follow-up tasks. It connects to Microsoft 365 work or school mailboxes that you choose to connect. Its AI features qualify contacts, draft messages and refine replies; a person reviews every draft, and nothing is sent unless a person sends it.
The AI features use your own Anthropic API key and account. You are responsible for that account, for any charges Anthropic makes, and for following Anthropic’s terms. Without a key, the AI features are off.
We are independent of Microsoft and Anthropic, and neither endorses FirstTouch Sales.
3. Accounts
We create accounts for your workspace. You are responsible for keeping sign-in details secure, for the people you add to your workspace, and for what they do in it. Tell us straight away at hello@firsttouch.si if you think an account has been misused.
4. Acceptable use
You agree not to use the service to:
- send bulk or unsolicited messages, or messages that break anti-spam or marketing laws;
- store or use contact details you have no lawful right to use;
- break the law or the rights of others;
- get around the service’s limits or security, or access another workspace; or
- resell or provide the service to others without our written agreement.
We may suspend access if we reasonably believe these terms are being broken, if there is a security risk, or if the law requires it. Where we can, we will tell you first.
5. Your data
The information you put into the service belongs to you. We use it only to provide the service, as described in our privacy policy. Only the people in your workspace can see your workspace’s data.
You can ask us to export or delete your workspace’s data by writing to office@pretiosus.cc.
6. Fees
Any fees, and how they are paid, are agreed with you before you are charged.
7. Availability and changes
We work to keep the service available but do not promise it will be uninterrupted or free of errors. It depends on services we don’t control, including Microsoft 365 and Anthropic. We may change or improve the service; if a change significantly reduces what it does, we will tell you in advance.
8. AI output
AI-drafted text can be wrong or incomplete. You are responsible for checking anything before you send or rely on it.
9. Disclaimer
Apart from what these terms say, the service is provided “as is”, without other promises or warranties, to the extent the law allows.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue or data. Our total liability to you for anything connected with the service is limited to the fees you paid us in the twelve months before the claim.
11. Indemnity
You agree to cover our reasonable losses arising from your breach of these terms or your unlawful use of the service, including how you handle other people’s personal data.
12. Ending the service
You can stop using the service at any time by telling us. We may end your access with reasonable notice, or straight away if you seriously break these terms. When access ends, we handle your data as our privacy policy describes.
13. Changes to these terms
We may update these terms. If a change is significant, we will tell you before it takes effect. Continuing to use the service after that means you accept the updated terms.
14. Law and courts
These terms are governed by the laws of India. The courts at Ernakulam, Kerala, India have jurisdiction. This does not take away any rights you have under the mandatory laws of your own country.
